Terms and conditions for using Leafscale services.

Acceptance of Terms

By accessing or using the services provided by Leafscale, LLC ("Leafscale," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

Leafscale reserves the right to modify these Terms at any time. Changes will be effective upon posting to this page. Your continued use of our services after any changes constitutes acceptance of the modified Terms.

Permitted Use

You may use our services only for lawful purposes and in accordance with these Terms. You agree not to:

  • Violate any applicable laws or regulations
  • Infringe upon intellectual property rights of others
  • Transmit malware, viruses, or other harmful code
  • Attempt unauthorized access to our systems or networks
  • Reverse engineer, decompile, or disassemble our software
  • Use our services to harm, harass, or defraud others
  • Interfere with the proper functioning of our services

Account Responsibilities

If you create an account with us, you agree to:

  • Maintain the confidentiality of your login credentials
  • Notify us immediately of any unauthorized access to your account
  • Keep your account information current and accurate
  • Accept responsibility for all activities under your account

Intellectual Property

All content, features, and functionality of our services—including but not limited to text, graphics, logos, code, and software—are the exclusive property of Leafscale, LLC and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use our services for personal or internal business purposes only. This license does not include the right to:

  • Resell or commercially exploit our services
  • Remove any proprietary notices from our materials

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not guarantee that our services will be uninterrupted, secure, or error-free. We make no warranties regarding the accuracy, reliability, or completeness of any content or information provided through our services.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEAFSCALE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of our services.

Our total liability for any claims arising from these Terms or your use of our services shall not exceed the greater of:

  • The amounts you paid to us in the preceding 12 months, or
  • One hundred dollars ($100)

Termination

We may terminate or suspend your access to our services at any time, with or without cause, and with or without notice. Upon termination:

  • Your right to use our services will immediately cease
  • You must delete any copies of our software or materials
  • Provisions that by their nature should survive will remain in effect

Dispute Resolution

Any disputes arising from these Terms or your use of our services shall be resolved through the following process:

  1. Informal Negotiation: We will first attempt to resolve any dispute informally by contacting each other directly.
  2. Binding Arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association.

Class Action Waiver: You agree to resolve disputes with us on an individual basis only. You waive your right to participate in class actions or class arbitrations.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which Leafscale, LLC is incorporated, without regard to conflict of law principles.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
